This Privacy Policy explains what information GymPropel collects, why we collect it, who we share it with, and what choices you have. It applies to https://gympropel.com and to the booking, email and text message communications we send.

We have written this in plain English on purpose. If anything here is unclear, email vincent@gympropel.com and we will explain it.

Who We Are

GymPropel is a marketing agency for gym owners in North America. We work with CrossFit boxes, personal training studios, group fitness studios and general fitness gyms. Our services include paid advertising (mainly on Meta platforms, and on Google where it fits), custom websites, AI-assisted lead follow-up by text, email and voicemail, and one-on-one strategy support.

In this policy, "we", "us" and "our" mean GymPropel. "You" means the person visiting our website or communicating with us.

Information We Collect

Information you give us directly

When you book a strategy call through the booking widget on our site, we ask for:

  • First name
  • Last name
  • Company name (your gym or studio)
  • Email address
  • Phone number

We also collect whatever you choose to tell us afterwards: on a call, over email, by text, or in messages you send us on social media. If you become a client, that will include business information such as your offers, pricing, membership numbers and advertising results.

Information collected automatically

When you visit our website, we automatically receive:

  • Your IP address and approximate location derived from it (usually city-level)
  • Browser type and version, device type, and operating system
  • Which pages you viewed, when, how long you stayed, and which page sent you to us
  • Cookie and pixel identifiers assigned to your browser or device

Information we do not collect

We do not ask for and do not want your payment card numbers, government ID numbers, health or fitness records, or any sensitive personal information. Please do not send those to us. If you become a paying client, payments are handled by a third-party payment processor and we never see or store your full card details.

Our website and services are for gym owners and operators. They are not directed at children, and we do not knowingly collect information from anyone under 18. If you believe a child has given us information, email us and we will delete it.

How We Use Your Information

We use the information we collect to:

  • Schedule and hold your strategy call, and send you confirmations and reminders
  • Follow up with you about working with GymPropel, including by phone, text, email and voicemail
  • Answer your questions and provide customer support
  • Deliver our services if you become a client, including running ads, building your website, and setting up your lead follow-up automations
  • Send marketing communications about our services, offers and content, where you have consented to receive them
  • Measure how our own advertising performs, and build audiences for retargeting
  • Understand how people use our website so we can improve it
  • Protect against fraud and abuse, and meet our legal and tax obligations

We do not sell your personal information. We do not rent or trade it. See the sections on text messaging and on California rights below for the specific commitments we make.

This is the most important section of this policy. Read it before you give us your phone number.

Express written consent

When you submit the booking form on gympropel.com, you provide your phone number. By submitting the form, you give GymPropel LLC your prior express written consent to send you text messages at the number you provided, including messages sent using an automatic telephone dialing system or pre-recorded or artificial voice, and including AI-assisted follow-up messages.

We separate two kinds of messages, and you consent to them separately:

  • Transactional messages relate to something you asked for: appointment confirmations, appointment reminders, scheduling changes, and replies to questions you sent us.
  • Marketing messages promote our services: offers, case studies, availability for new clients, and reminders to book.

Consent is not a condition of purchase

You do not have to agree to receive marketing text messages in order to buy anything from us or to work with us. Consent to marketing messages is never a condition of purchasing any goods or services from GymPropel. If you would rather not receive texts, email vincent@gympropel.com instead and we will book your call and work with you by email.

Message frequency

Message frequency varies. It depends on where you are in our follow-up sequence and whether you reply. As a guide, expect roughly 2 to 8 messages per month, and more in the days immediately around a booked call.

Message and data rates

Message and data rates may apply to messages we send you and to messages you send us. Those charges come from your mobile carrier, not from us. For questions about your text or data plan, contact your wireless provider.

How to stop messages

You can cancel at any time. Reply STOP to any message from us. We will send one final message confirming that you have been unsubscribed, and after that you will not receive further texts from us unless you sign up again. You may also email vincent@gympropel.com and ask us to remove your number.

How to get help

Reply HELP to any message from us for assistance, or email vincent@gympropel.com. You can also call us at (613) 797-9368.

Carrier liability

Mobile carriers are not liable for delayed or undelivered messages.

Your mobile opt-in data is not shared or sold

This is a firm commitment:

  • No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.
  • Text messaging originator opt-in data and consent will not be shared with any third party, except with the messaging service providers and carrier aggregators that are strictly necessary to deliver the messages you asked for.
  • Sharing with subcontractors who support the service, such as customer support or scheduling, is permitted only so they can perform that support work for us. They may not use your information for their own marketing.
  • We never sell phone numbers or SMS consent data.

Email Marketing

If you give us your email address, we may send you marketing email about our services. Every marketing email includes an unsubscribe link, and we honour unsubscribes promptly. You can also reply to any email and ask us to stop, or email vincent@gympropel.com.

Unsubscribing from marketing email does not stop transactional email, such as an appointment confirmation or a message about work we are doing for you as a client. To stop those, tell us you want to end the conversation entirely and we will close your record.

Who We Share Information With

We share your information only with the service providers we need in order to run our business, and only for the purposes described here. Each of these acts as a processor on our behalf and is bound to use your information only as we instruct.

  • GoHighLevel - our customer relationship management (CRM) platform. Everything you submit through the booking widget is stored in GoHighLevel: your name, company name, email, phone number and consent status. GoHighLevel also sends our text messages, emails and voicemail drops, and stores the record of your conversations with us.
  • Google Calendar - used to schedule your strategy call. Your name, email address and the appointment time are written to our calendar, and a calendar invitation is sent to your email address.
  • Meta Platforms (Facebook and Instagram) - we may run the Meta Pixel on our website for advertising measurement and retargeting. See the tracking section below.
  • Google - we may use Google Analytics 4 to understand website traffic. See the tracking section below.
  • Web hosting and email providers - the infrastructure that serves our website and carries our email.
  • Payment processor - if you become a paying client, a third-party processor handles your payment. They receive what they need to process it; we do not receive or store your full card number.
  • Professional advisors - accountants and lawyers, where necessary and under a duty of confidentiality.

We will also disclose information if the law requires it, for example in response to a valid subpoena or court order, or where we need to do so to protect our rights, safety or property. If our business is ever sold or merged, your information may transfer to the new owner, who would remain bound by this policy or would notify you of any change.

Apart from these situations, we do not share your personal information with anyone. We never sell it.

Cookies and Tracking Technologies

Cookies are small files placed on your device by a website. We use cookies and similar technologies such as pixels and tags for the following purposes:

  • Essential cookies - needed to make the website and the booking widget work. These cannot be turned off through our site.
  • Analytics cookies - if enabled, Google Analytics 4, which tells us how many people visit, which pages they read, and where they came from. This is reported to us in aggregate.
  • Advertising cookies - if enabled, the Meta Pixel, which tells us whether our ads led to a booking and lets us show ads to people who visited our site but did not book. The Meta Pixel may send Meta a hashed version of information you submit, such as your email address, so Meta can match it to an account.

You have several ways to control this:

  • Set your browser to refuse or delete cookies. Some parts of our site may not work properly if you do.
  • Install the Google Analytics Opt-out Browser Add-on.
  • Adjust your Meta ad preferences in your Facebook or Instagram account settings.
  • Use your browser's or device's "Do Not Track" or Global Privacy Control signal. Where we are legally required to honour a Global Privacy Control signal as an opt-out of sharing for targeted advertising, we do.

Where Your Information Is Held and How Long We Keep It

We operate from Ontario, Canada, and our service providers store and process data in the United States and Canada. If you are contacting us from outside North America, your information will be transferred to and processed in those countries, which may have different data protection laws than your own.

We keep lead information in our CRM for 3 years after our last contact with you, unless you ask us to delete it sooner. Client records, contracts and invoices are kept longer where tax and accounting law requires it. Records of SMS opt-outs are kept indefinitely, because we need them to make sure we never message you again by mistake.

How We Protect Your Information

We use encrypted connections (HTTPS) on our website, restrict access to our CRM to people who need it, and use strong authentication on the accounts that hold your data. No method of transmitting or storing information over the internet is completely secure, so we cannot guarantee absolute security, but we take it seriously and we will notify you if a breach affects your information and the law requires us to do so.

Your Choices

Whatever jurisdiction you are in, you can always:

  • Reply STOP to any text message to stop texts
  • Click unsubscribe in any marketing email to stop marketing email
  • Email vincent@gympropel.com to ask what we hold about you, to correct it, or to have it deleted

We will not treat you differently, refuse to work with you, or charge you a different price because you exercised a privacy right.

California Privacy Rights (CCPA and CPRA)

If you are a California resident, the California Consumer Privacy Act as amended by the California Privacy Rights Act gives you specific rights.

What we collect about Californians

In the past twelve months we have collected these categories of personal information: identifiers (name, email address, phone number, IP address), commercial information (the fact that you booked or enquired, and what services you bought), internet activity (pages viewed, referring site), geolocation data (approximate, from IP address), and professional or employment-related information (your gym or company name and your role there). We collect it from you directly and automatically from your device, for the business purposes described in "How We Use Your Information".

We do not sell your personal information

We do not sell personal information and have not sold personal information in the past twelve months. We do not sell or share the personal information of anyone we know to be under 16.

When the Meta Pixel is running on our site, we "share" personal information for cross-context behavioural advertising in the narrow sense the CPRA uses that word, because it passes browsing and identifier data to Meta for retargeting. You can opt out of this. To do so, use the browser and Meta controls listed under "Cookies and Tracking Technologies", send a Global Privacy Control signal, or email us at vincent@gympropel.com with the subject line "Do Not Share My Personal Information" and we will disable it for you.

Your rights

  • Right to know what personal information we have collected about you, where we got it, why we collected it, and who we disclosed it to.
  • Right to delete the personal information we hold about you, subject to legal exceptions such as records we must keep for tax purposes or to honour your opt-out.
  • Right to correct inaccurate personal information.
  • Right to opt out of the sharing of your personal information for cross-context behavioural advertising.
  • Right to limit the use of sensitive personal information. We do not collect sensitive personal information as the CPRA defines it, so there is nothing to limit.
  • Right to non-discrimination for exercising any of these rights.

How to make a request

Email vincent@gympropel.com with "California Privacy Request" in the subject line and tell us which right you want to exercise. We will verify your identity by matching the details you give us against what we already hold, usually your email address and phone number, and we may email you to confirm. We will respond within 45 days, and will tell you if we need a further 45 days.

An authorised agent may make a request for you. We will ask for written proof that you gave them permission, and we may ask you to confirm it directly.

Other U.S. State Privacy Rights

Residents of other states with comprehensive privacy laws, including Virginia, Colorado, Connecticut, Utah, Texas, Oregon and Montana among others, have broadly similar rights to access, correct, delete and obtain a copy of their personal data, and to opt out of targeted advertising. We extend the same process to you: email vincent@gympropel.com and we will handle your request. If we deny a request, you may appeal by replying to our decision, and we will respond to the appeal in writing.

Canadian Privacy Rights (PIPEDA and CASL)

If you are in Canada, you have the right to access the personal information we hold about you and to ask us to correct it. You may also withdraw your consent to marketing communications at any time, subject to legal or contractual restrictions and reasonable notice. Our commercial electronic messages identify us, give our contact details, and include an unsubscribe mechanism, as Canada's Anti-Spam Legislation requires. Email vincent@gympropel.com to exercise these rights.

Rights in the European Economic Area and the United Kingdom (GDPR)

We market to gym owners in North America, but our website is reachable from anywhere. If you are in the EEA or the UK and you use our website or contact us, this section applies to you.

Controller

GymPropel LLC, trading as GymPropel, is the data controller for the information described in this policy. Contact: vincent@gympropel.com.

Our legal bases for processing

  • Consent - for marketing text messages, marketing email, and non-essential cookies including the Meta Pixel and Google Analytics. You can withdraw consent at any time, and withdrawal does not affect processing we carried out before you withdrew it.
  • Performance of a contract, or steps taken at your request before entering one - for scheduling and holding your strategy call, and for delivering our services if you become a client.
  • Legitimate interests - for securing our website, preventing fraud, and understanding in aggregate how our site is used. We balance these against your rights and stop if yours outweigh ours.
  • Legal obligation - for tax, accounting and records we are required to keep.

Your rights

You have the right to access your personal data, to have it corrected or erased, to restrict or object to how we process it, to data portability, and to withdraw consent. You also have the right not to be subject to a decision based solely on automated processing that produces legal or similarly significant effects. Our AI-assisted follow-up sends messages and suggests replies; it does not make decisions that legally or significantly affect you.

To exercise any of these rights, email vincent@gympropel.com. We will respond within one month. If you are not satisfied, you have the right to lodge a complaint with your national supervisory authority, or with the UK Information Commissioner's Office if you are in the UK.

International transfers

Your data will be transferred to and stored in the United States and Canada. Where we transfer personal data out of the EEA or the UK, we rely on appropriate safeguards, including the European Commission's Standard Contractual Clauses and the UK International Data Transfer Addendum, in our agreements with our service providers.

Our site may link to other websites we do not control, including our clients' sites and our social media profiles. We are not responsible for their content or their privacy practices. Read their privacy policies before giving them your information.

Changes to This Policy

We may update this policy from time to time. When we do, we will post the new version on this page and change the "Last updated" date at the top. If the change is significant, we will give you notice by email or with a clear notice on the website before it takes effect. Changes take effect when they are posted.
